From Conflict To Clarity

Mediation

Welcome to Mindful Resolutions Mediation Services – Your Path to Conflict Resolution

At Mindful Resolutions, we are dedicated to providing civil and commercial mediation services that prioritise harmony, understanding, and cost-effectiveness.

Our approach is tailored to address your unique needs, ensuring that both parties feel empowered and heard throughout the mediation process. Unlike traditional litigation, which can be lengthy, costly, and adversarial, mediation offers a collaborative solution that fosters better relationships and preserves valuable time and resources.

Prioritising Harmony

Mediation Services

Mediation is a voluntary, confidential, and flexible process aimed at resolving disputes outside of the courtroom.

The role of a Mediator is to facilitate discussions, guiding parties towards mutually acceptable solutions while maintaining impartiality. By addressing underlying issues and promoting open dialogue, mediation helps parties feel heard and empowered to find common ground. With early intervention, tensions can be alleviated, and relationships can be preserved, fostering a positive and cooperative environment.

Our mediation process is designed to be straightforward and collaborative.

We begin with a no-obligation chat to gather information and assess the suitability of mediation for your case.

Each party meets individually with our mediator to discuss the case and understand the mediation process.

Parties meet in a joint session whereby the Mediator will go through the process in what is called an ‘Opening Statement’. Each of the parties will then have the opportunity to make a brief opening statement, outlining the case from their perspective, how it has made them feel and what resolution they would like to end the day with.  The parties then go into separate, private rooms whereby the Mediator will chat in detail about their issues, the resolutions they would like and eventually the solution to each individual issue.  These individual sessions will continue until each of the party’s issues have a solution that they both agree upon.

The Mediator’s role throughout these sessions is to be completely impartial, non-judgemental, and to keep the parties’ discussions on track. The mediator will not give legal advice and will not provide a solution.  The parties need to come up with the solutions for each issue. The great thing about solving your dispute through mediation is that you can be as creative as you want when it comes to agreeing a solution to an issue, as long as it is legal.

Everything that is discussed in these private sessions is confidential and will not be discussed with the other party, without express permission. All of the discussions, whether in the open session or in the private sessions are confidential.  It is non-binding and cannot be used in court if the mediation fails to reach an amicable agreement.  Mediation is a safe space to get all issues on the table and can only succeed if the parties feel they are in a safe space.  Please be assured that all conversations throughout the mediation process are covered by the confidentiality aspect of the Mediation Agreement.

Upon reaching a mutually acceptable solution, the parties draft and sign a legally binding mediation agreement outlining the terms of the resolution.
